Children and adolescents are increasingly immersed in online and connected environments. Their personal data is being processed across various contexts, leading to the creation of digital profiles from an early age. In addition to leaving larger digital footprints than previous generations, they face heightened vulnerability due to their developmental stage.

To safeguard their best interests, it is crucial to ensure robust protection of their personal information and privacy – fundamental rights that support the free development of personality, individual and collective freedoms, and protection against discrimination.

This work aims to thoroughly discuss and underscore the need for stricter safeguards for the privacy and data protection of children and adolescents in Brazil, especially in light of ongoing technological advancements and the multitude of data-processing entities in today’s surveillance society. It seeks to establish a doctrinal framework on the subject, mainly through an interpretation of the General Data Protection Law (LGPD), to inform work in the field, judicial decisions, and public policy.

We hope this openly and freely available work will deepen one’s understanding of this important topic and help promote the rights of children and adolescents in the online space.
